Pet Marketplace Policy

Welcome to the Liztd Pet Marketplace, a platform designed to facilitate the ethical listing, adoption, and sale of pets while promoting responsible pet ownership and compliance with applicable laws. By accessing or using the Pet Marketplace, you agree to this Pet Marketplace Policy (“Policy”), which forms a part of the Liztd Terms of Use.

This Policy outlines user responsibilities, prohibited activities, and Liztd’s limited role in the transaction process.

User Responsibilities

By listing or purchasing pets on Liztd, you agree to the following responsibilities:

Legal Compliance

Compliance with Laws: You must comply with all applicable federal, state, local, and international laws, including but not limited to:

  • The Animal Welfare Act (AWA)
  • The Endangered Species Act (ESA)
  • State-specific animal sale and welfare regulations

Licensing Requirements: Sellers must obtain and maintain any required licenses, permits, or certifications for the sale or rehoming of animals in their jurisdiction.

Accurate Listings

  • Truthful Information: All pet listings must include accurate and complete information, such as the pet’s breed, age, health condition, vaccinations, and any special needs.
  • Prohibited Misrepresentation: Misrepresentation of any aspect of the pet is strictly prohibited.

Ethical Practices

Prohibited Activities: Users are prohibited from listing or facilitating the sale or transfer of:

  • Endangered or exotic species without proper documentation and permits
  • Animals bred or obtained in violation of applicable laws
  • Animals intended for illegal activities, such as fighting

Minimum Age Requirements: Pets must meet the minimum age for sale or adoption as required by law (e.g., 8 weeks for puppies or kittens in most jurisdictions).

Prohibited Activities

The following activities are strictly prohibited on the Liztd Pet Marketplace:

  • Animal Trafficking: The sale, transfer, or listing of animals obtained through illegal or unethical means.
  • Inhumane Treatment: Listings or practices that involve cruelty, neglect, or abuse of animals.
  • Unverified Claims: Posting unverifiable or exaggerated claims about a pet’s breed, health, or behavior.
  • Sale of Prohibited Animals: Listing animals that are illegal to own or sell in the jurisdiction where the listing is posted or viewed.

Liztd reserves the right to remove any listing that violates this Policy or applicable laws.

Platform Disclaimer

Limited Role

  • Liztd is a marketplace platform that facilitates user-generated listings. Liztd does not own, inspect, or take custody of the pets listed on the platform.
  • Liztd does not verify the accuracy or legality of user-generated listings or the actions of sellers and buyers.

No Endorsement

  • Liztd does not endorse, guarantee, or warrant the quality, safety, or legality of any pets listed on the platform.

Liability Disclaimer

By using the Pet Marketplace, you agree that Liztd is not responsible or liable for:

  • Disputes arising from transactions between users
  • Inaccuracies or misrepresentations in pet listings
  • Health conditions, behavior, or suitability of listed pets
  • Violations of applicable laws by users
Reporting Violations

Liztd provides tools for users to report suspicious or prohibited listings or activities. To report a violation:

  • Use the “Report Listing” feature available on each pet listing.
  • Contact Liztd’s support team at support@liztd.com with details about the violation.

Liztd reserves the right to investigate reported violations and take appropriate action, including removing listings, suspending user accounts, and reporting violations to law enforcement or regulatory authorities.

Indemnification

By using the Pet Marketplace, you agree to indemnify and hold harmless Liztd, its affiliates, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your violation of this Policy or applicable laws
  • Disputes between you and other users
  • Any harm caused by pets purchased or sold through the platform

Liztd may update this Policy periodically to reflect changes in laws, regulations, or platform practices. Significant changes will be communicated via email or platform notices at least 30 days before taking effect.

Responsible Use

  • Avoid posting content that is illegal, harmful, or misleading.
  • Refrain from harassing, exploiting, or abusing other users.

Liztd reserves the right to moderate, remove, or block content and users to protect the platform and its community.

Fees and Premium Features

Basic use of Liztd is free. However, certain features or services may require payment. By purchasing premium services, you agree to:

  • Pay any applicable taxes and fees.
  • Authorize recurring charges for subscriptions until canceled.

Fees are non-refundable unless required by law. Liztd reserves the right to modify, refuse, or cancel premium services at its discretion.

Personals Section

The Personals section is designed for personal connections but requires strict adherence to safety standards and legal compliance:

  • All content must comply with the Allow States and Victims to Fight Online Sex Trafficking Act (FOSTA) and the Stop Enabling Sex Traffickers Act (SESTA).
  • Prohibited activities include solicitation, trafficking, harassment, or other illegal conduct.
  • Liztd employs automated and manual moderation tools to detect and address violations.
  • Users can report violations via our reporting system.

Liztd disclaims liability for user-generated content but will take necessary action, including notifying law enforcement, when violations are identified.

Privacy and Cookies

Limitation of Liability

  • Liztd prohibits the use of the Personals section for illegal activities, including but not limited to prostitution or human trafficking, as mandated by FOSTA-SESTA.
  • Reports of inappropriate use or content can be submitted via our reporting tools. These reports will be reviewed, and appropriate actions, such as content removal or notifying law enforcement, will be taken.
  • Liztd actively works to prevent the misuse of the Personals section through automated and manual moderation tools, designed to detect and mitigate prohibited content.

Your Rights as a California User

Under the California Consumer Privacy Act (CCPA), California residents have the following rights:
